Privacy policy

Protecting the privacy of our users is a priority for us. Therefore, individuals using the website www.atthrea.com (hereinafter referred to as the “Online Shop”) can be assured that their data is subject to the highest standards of privacy protection. Atthrea GmbH, as the data controller, ensures the security of information provided by users.

In accordance with the requirements arising from the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”), we have adopted this Privacy Policy. This Privacy Policy describes the principles of processing and protecting personal data provided by users in connection with the use of the Online Shop and related websites, communications, and services.

Users are individuals whose data is involved and who use the Online Shop and its associated websites, communications, and services (hereinafter referred to as “Users”). Atthrea GmbH is the data controller for the personal data collected in the Online Shop. The company is based in Berlin, Kurfürstenstr. 114, 10787 Berlin, Germany, registered with the Chamber of Commerce under registration number HRB 248478, VAT ID DE359262571, share capital 25,000 EUR (hereinafter referred to as the “Controller”).

To the extent necessary for the performance of the contract between the User and the Controller, as well as for carrying out actions in accordance with the User’s request and for fulfilling legal obligations resting upon the Controller, the processing of the User’s personal data is based on the provisions of the law, namely Article 6(1)(b) and (c) of the GDPR, without the need for obtaining the User’s consent for the processing of personal data. In other cases, providing personal data by Users is voluntary. However, if the User consents to the processing of their personal data for marketing purposes, providing such data is voluntary. In the event of refusal to give consent or its withdrawal, the Controller will not be able to inform the User about new offers and promotions.

I. USER CONSENT

The use of the Online Shop by the User signifies their acceptance that the Controller collects, processes, and shares personal and non-personal data in accordance with this Privacy Policy. However, the User maintains full control over how their data is used and shared, as detailed in Chapter V of this Privacy Policy, “User Rights”. In the case of processing personal data based on the User’s consent, they have the right to withdraw this consent at any time. Withdrawal of consent does not affect the lawfulness of processing that occurred before its withdrawal. The Controller informs the User about the possibility of withdrawing consent before its expression. In the event of changes to this Privacy Policy, a User who continues to use the Online Shop is considered to have accepted the new terms of the Privacy Policy.

Chapter II. PERSONAL DATA PROCESSED BY THE CONTROLLER

  1. Method of Obtaining Personal Data
    1. Personal Data Obtained Directly from the User atthrea GmbH obtains personal data in two main ways. The first is by acquiring personal data directly from the User through:
      • Sending messages by the User via the contact form provided on the Online Shop,
      • Creating a customer account in the Online Shop by the User,
      • Placing orders for goods or services in the Online Shop,
      • Contacting the Administrator by the User for technical support, submitting complaints, or for other purposes.
    2. Personal Data Obtained from Other Sources atthrea GmbH also obtains personal data from sources other than directly from the User, such as:
      • Registering the User’s use of the Online Shop through cookies and other technologies, as well as receiving error reports or usage data from software operating on the User’s device,
      • Obtaining data from partners with whom atthrea GmbH jointly offers products and services or conducts marketing activities.
  2. Personal Data Processed by the Controller

    The scope of personal data collected from Users by atthrea GmbH may vary depending on the purpose of processing these data. The Controller collects, among other things, the following personal and non-personal data:
    • Username,
    • First and last name,
    • Mailing address,
    • Phone number,
    • Email address,
    • IP address of the computer,
    • Payment information if the User makes a purchase in the Online Shop,
    • Information contained in cookies and similar technologies regarding the User’s interactions with the atthrea GmbH Online Shop.

Additionally, the Controller collects information about the content of User files and messages when it is necessary to fulfill a placed order, provide customer account services, including: the subject and content of emails, text or other content of instant messages, audio and video recordings of video messages, audio recordings and transcriptions of voice messages received from the User or transformed into a text message. The Controller also collects information provided by the User, such as product and service reviews and ratings, as well as information provided for technical support. Furthermore, in the event of contact with the Controller, the content of the messages is also collected.

III. METHOD OF PROCESSING DATA – PURPOSES OF PROCESSING PERSONAL DATA BY THE CONTROLLER

The method of processing Users’ personal data by atthrea GmbH depends on the extent of the User’s use of the Online Shop.

  1. Orders, Customer Accounts (Contract Execution) 

    When a User decides to place an order for products or services presented in the Online Shop, atthrea GmbH processes the User’s personal data to the extent necessary to conclude a sales contract or a contract for the provision of services and to ensure the effective performance of the contract with the User. If the User creates a customer account in the Online Shop, atthrea GmbH uses the User’s personal data to ensure the proper provision of electronic services, including authorization and authentication of access to the customer account.
  1. Communication (Contract Execution, Legitimate Purpose Pursued by the Controller) 

    Personal data of the User is used by atthrea GmbH for personalized communication with the User. This communication includes sending emails, placing notifications on web pages, and other means that pertain to the functioning of the Online Shop and the service provided to the customer account. Within this communication, the User receives information regarding service availability, its utilization, data security matters, updates, reminders, as well as suggestions of offers from the Controller. Communication with the User also encompasses customer support. Personal data is used to provide assistance, resolve issues, and respond to User complaints. If the Online Shop features a commenting function for activities, products, and services, the Controller may use the User’s personal data to enable commenting.
  1. Advertising (Consent, Legitimate Purpose Pursued by the Controller) 

    atthrea GmbH uses the User’s personal data to present personalized advertisements if the User has given consent or if there is a legitimate business purpose between the Controller and the User. These advertisements concern products offered by the Controller. Advertisements directed at the User are tailored individually (so-called “profiling”) using:
    • Data directly provided by the User,
    • Data obtained during the User’s use of the Online Shop,
    • Information provided by third parties,
    • Data derived from advertising technologies, such as cookies,
    • Navigational signals, pixels, ad tags, and mobile identifiers.

atthrea GmbH does not provide the User’s personal data to advertisers or advertising networks without the User’s consent. However, in the event the User clicks on an advertisement, the advertiser will be informed about it.

  1. Improving the Online Shop (Legitimate Interest Pursued by the Controller) 

    Personal data of Users is used by atthrea GmbH for conducting analytical and statistical activities aimed at continuously improving the Online Shop, offered products and services, introducing new features, and enhancing solutions. User personal data is also used by the Controller for market analysis, public opinion research, and conducting economic analyses to constantly improve the Online Shop.
  1. Security (Legitimate Interest Pursued by the Controller) 

    User personal data is used by atthrea GmbH to monitor, prevent, detect, and combat fraud and abuses, protect other Users from such actions, and ensure network and data security. In cases where reasonable suspicions of a crime exist, the User’s personal data will be used to conduct an investigation regarding the alleged offense or violation of this Privacy Policy.
  1. Claims Settlement (Legitimate Interest Pursued by the Controller) 

    If the User chooses to use the Online Shop, particularly by creating a customer account or placing orders for products or services, atthrea GmbH may process the User’s personal data to pursue potential claims arising from the conducted business activity and to analyze potential breaches of the rules for using the Online Shop.
  1. Tax Documentation (Statutory Obligation) 

    If the User places orders for products or services through the Online Shop, atthrea GmbH processes the User’s personal data to the extent necessary for tax documentation and settlement related to order fulfillment.

IV. SHARING/DISCLOSURE OF PERSONAL DATA BY THE CONTROLLER

Personal data of Users is or may be disclosed to the following categories of recipients, based on appropriate agreements or legal provisions:

  1. Courier/Postal Service Providers, Payment Intermediaries:
    • Personal data may be shared with courier and postal service providers, as well as with payment intermediaries involved in the payment process for orders placed by Users, to facilitate delivery and payment.
  2. Advertising and Marketing Service Providers:
    • For the purpose of achieving marketing goals related to atthrea GmbH’s own services, personal data may be shared with advertising and marketing service providers.
  3. Legal Services, Advisors, and Debt Collection Agencies:
    • Personal data may be shared with legal service providers, advisors, and debt collection agencies that assist atthrea GmbH in the claims settlement process.
  4. Data Processors on Behalf of atthrea GmbH:
    • Personal data may be shared with entities processing personal data on behalf of atthrea GmbH, such as technical service providers responsible for maintaining the technical infrastructure of the Online Shop.
  5. Judicial and Law Enforcement Authorities:
    • Personal data may be disclosed to judicial authorities, law enforcement agencies, or other entities authorized to obtain data based on applicable law when they make requests in accordance with relevant legal provisions.

V. USER RIGHTS

The User has the right to control their personal data, including selecting which personal data is disclosed and configuring privacy settings. However, the User should be aware that in such a case, they may not be able to fully utilize certain features of the Online Shop or services offered by atthrea GmbH.

  1. Right of Access to Data
    • The User has the right to obtain confirmation from atthrea GmbH as to whether their personal data is being processed and, if so, has the right to access information about the details of this data processing, including the purpose of processing and categories of processed data.
  2. Right to Rectification of Data
    • The User has the right to have inaccurate personal data corrected. They may request correction, completion, or deletion of errors, defects, or incorrect information in the dataset concerning their person. However, the User cannot demand the replacement or supplementation of incorrect data.
  3. Right to Erasure (Right to Be Forgotten)
    • The User has the right to request the erasure of their personal data under certain circumstances, such as when: a) Personal data is no longer necessary for the purposes for which it was collected or otherwise processed. b) The User withdraws the consent that formed the basis for processing, and there is no other legal basis for the processing. c) The User objects to the processing of their personal data. d) The personal data was processed unlawfully. e) Erasure is required to fulfill a legal obligation imposed on atthrea GmbH. f) The personal data was collected in connection with offering information society services.
    • The right to be forgotten is applicable to the User only if the conditions for the erasure of personal data are met, and only if the personal data has been made public by atthrea GmbH.
  4. Right to Restriction of Processing
    • The User has the right to restrict the processing of their personal data in the following situations: a) The User contests the accuracy of personal data – during the period allowing atthrea GmbH to verify the accuracy of this data. b) The processing is unlawful, and the User opposes the erasure of personal data, requesting the restriction of processing. c) atthrea GmbH no longer needs the User’s personal data for processing purposes, but they are required by the User for the establishment, exercise, or defense of legal claims. d) The User has objected to the processing – pending the verification of whether the legitimate grounds on the part of atthrea GmbH override the User’s objection.

If processing is restricted, atthrea GmbH may process personal data only: 

  1. With the User’s consent, 
  2. For the establishment, exercise, or defense of legal claims, 
  3. To protect the rights of other natural or legal persons, 
  4. For reasons of significant public interest of the Union or a Member State.
  1. Right to data portability 

    The User has the right to receive their personal data in a structured, commonly used, and machine-readable format that they have provided to the Administrator. The User also has the right to transmit this data to another administrator, if technically feasible.
  1. Right to object 

    The User has the right to object, at any time, to the processing of their personal data for reasons related to their particular situation, especially in the following cases: a) In the public interest, as part of the exercise of public authority entrusted to the Administrator. b) Against the processing of personal data for direct marketing purposes, including profiling, to the extent related to such direct marketing. c) For legitimate purposes pursued by the Administrator. The procedure for considering objections and all communication in this matter is free of charge, and the User has the option to raise objections electronically.
  1. Right to lodge a complaint 

    The User has the right to lodge a complaint with the relevant supervisory authority for the protection of personal data, especially in the Member State of the European Union where they have their habitual residence, place of work, or the place of the alleged violation of their rights in terms of personal data protection.

VI. COOKIES AND OTHER TECHNOLOGIES USED BY THE ADMINISTRATOR

We use cookies to improve the efficiency and offer the User increasingly advanced features of the Online Shop, as well as content more tailored to the User.

Cookies are pieces of code, text files that correspond to HTTP requests sent to our server. These files are stored by each browser from which the User visits our Online Shop. By examining the information contained in cookies, we understand how Users use our Online Shop. This knowledge is essential for us, as the atthrea Online Shop is a fundamental sales tool for our products, without which the existence and development of our company would be impossible.

The atthrea Online Shop uses two types of cookies:

  • Session cookies – these are temporary files that remain on the User’s device until they leave the Online Shop or close the web browser. In such cases, the information stored in session cookies is automatically deleted.

In the area of the Online Shop, we also use other available technologies that allow storing information in the browser in appropriate data storages (Session Storage, Local Storage).   1.  USE OF COOKIES AND SIMILAR TECHNOLOGIES

We use cookies and other similar technologies to recognize the User during their visits to our Online Shop, remember their preferences, and display relevant content, including personalized advertisements. These solutions make interactions between the User and us faster and more effective. Additionally, these technologies allow us to present content tailored to the User without the need for surveys.

Below, we describe the specific categories in which cookies and similar technologies are used on our Online Shop:

Basic Cookies – Installed when the user gives consent through their browser settings. Within basic cookies, we distinguish technical and analytical cookies.

a. Technical Cookies – Necessary for the website to function correctly, including user authentication, allowing the User to navigate between pages on the website without the need to log in again on each page.     • Then choose the “Privacy” tab.

    • Check “Accept cookies” to enable, uncheck to disable cookie support.
    • Choose the cookie storage period:
      • Keep until: they expire – cookies will be deleted when they expire, as determined by the website sending the cookie.
      • Keep until: I close Firefox – cookies stored on the computer will be deleted when Firefox is closed.
      • Keep until: ask me every time – whenever a website tries to send a cookie, the browser will display a prompt to decide whether to store the cookie.
    • Close the options window to save the settings.

VII. Other Important Information

  1. Protection of Personal Data Security 

    The Administrator implements various measures to ensure the security of the User’s personal data. Secure use of the provided services is ensured through applied systems and procedures that protect against unauthorized access and disclosure of data to unwanted individuals. Additionally, the systems and procedures used by the Administrator are regularly monitored to detect potential threats. Personal data obtained by the Administrator is stored in computer systems with strictly limited access.
  1. Storage of Personal Data 

    The period of storage of Users’ personal data may vary due to different processing purposes for these data. The Administrator retains personal data for the time necessary to achieve specific purposes, namely: a. In the case of analytical and statistical purposes – for the period necessary to achieve goals related to the effective functioning and development of the Online Shop; b. In the case of order fulfillment and service provision to the User – for the duration of the contract and the limitation period for claims; c. For the period required by tax law regulations in relation to the purpose of maintaining tax documentation and settlements from concluded contracts; d. In the case of processing personal data for marketing purposes – for the duration of the business relationship with the User, unless the User objects to such processing in these purposes.

In each of the above cases, after the necessary processing period has elapsed, the data may only be processed for the purpose of securing claims or defending against them, and after that time, only to the extent required by law. Users’ personal data is stored in the Administrator’s database, which has been equipped with technical and organizational measures to protect the processed data in accordance with the requirements specified in the applicable law. Access to the database is granted solely to the Administrator.

  1. Changes to the Privacy Policy 

    In order to update the information contained in this Privacy Policy and ensure its compliance with applicable legal regulations, this Privacy Policy may change. When the content of the document changes, the updated date will also change, and this will be mentioned at the beginning of this Privacy Policy. However, in the case of any significant changes, Users will be informed through information posted on the Online Shop website or directly.
